Associate Director Government Contracts & Reporting
Associate Director of Government Contracts and Reporting Our client is a global research-based pharmaceutical company with a vast global network and a robust product. They have asked us to assist them in their search for an Associate Director, Government Contracts & Reporting. The Associate Director Government Contracts & Reporting will manage and control the activities of the government contracting and mandated price reporting operations functions to maximize the company's profitability and market share in concert with Managed Markets, Product Management, Legal and Finance, while minimizing the company’s legal risks and staying within the confines of government regulations. Contract responsibility includes all Pharmaceutical and Biological government contracting of products to ensure sound contracting parameters by influencing and incorporating brand strategy into the market and contracting strategy. The Associate Director will ensure commercial and government contract compliance and analysis of performance for all customer segments; administer government contracts; manage the implementation, changes to and management of pricing systems to ensure accurate calculation and reporting of government mandated price reporting; identify, evaluate and implement policies and procedures in accordance with government agreements which previously have not been instituted by the government agencies (Corporate Integrity Agreement and Medicare prescription coverage). Specific responsibilities will include: Managing of the yearly Internal Review Organization audit for compliance to the corporate integrity agreement. Calculating and reporting to government agencies all covered drugs participating in federal and state healthcare programs. Supporting on-site government audit in reference to reported pricing and calculation methods. Participating in the development of long range government contracting/pricing strategies ensuring that the strategy is integrated with the business and financial strategies for each company product while monitoring the company’s pricing strategies for legal and government compliance regarding mandated agreements and legislated programs which often requires significant interaction with outside legal counsel. Focal point for all legal subpoena requests and litigation involving pricing and government contracting. Leading the Medicaid contracting process including the company’s participation in all Medicaid related activities including State Pharmacy Assistance Programs (SPAPS) as well as the Supplemental Bid Process. Developing, enhancing, and implementing organizational controls for all government contracts, Medicaid rebates, contract compliance, forecasting and analysis to maximize profitability, market share in the short and long term for the pharmaceutical and biological domestic markets. Directing and monitoring all government contract sales activities and other government legislated rebate programs ensuring adherence to all state and federal guidelines. Negotiating, approving and signing contracts with government customers to protect the company’s interests. Monitoring reparations of quarterly reports for certain drug pricing information providing pricing information that accurately reflects the prices at which actual purchasers buy the Government Reimbursed Products sold by the company as outlined in the CIA. Managing the pricing audit process of the Independent Review Organization to ensure compliance with the CIA. Providing financial data concerning government rebates to Finance/Controlling/Accounting departments for use in the rebate accrual process. We seek candidates with the following qualifications: BA degree or equivalent together with a minimum of 10 years of high level pharmaceutical experience is required. Expert knowledge of government pricing regulations, Federal and State healthcare programs including Medicare, Medicaid, business administration, knowledge of the managed care health care environment and supply chain management. Must be able to visualize and structure creative customer "contract alliances" to utilize company resources while maximizing profit and ensuring legal compliance. Expert understanding level of financial principles is essential. Must be able to direct the utilization of advanced information technology data and various data sets (rebate utilization data, per member per month, Medicaid rebate analysis) in order to assess impact to profitability. Sensitivity to people with varying backgrounds is a must since the director must have contact with all levels of people within and outside of company with different professional backgrounds. Highly developed communication skills. Understanding of the supply chain management business model including forecasting, manufacturing planning, ordering and distribution of products is essential as 95% of company’s ex-factory sales are distributed through the wholesaler distribution network. Expertise regarding government pricing obligations and impact as it relates to company’s profitability and legal implications. Failure to understand the intricacies of such relationship will compromise company's ability to be in compliance with such pricing laws. Minimal travel.
