The Director, Health Care Compliance (HCC) is responsible for the company for matters regarding the health care fraud and abuse laws, governing the company's commercial and scientific activities. This key position assures the independence and visibility of our compliance activities and reinforces the message that compliance is a company priority. As described in greater detail below, this function is responsible for providing appropriate advice and counsel on all HCC related matters and creating and facilitating the policies and procedures that define acceptable company practices under the health care regulatory and fraud and abuse laws. The incumbent will partner with the Board and others management in providing advice and counsel on all HCC related matters, participate on a number of management review committees and formal meetings including, Business Plans, contract review committee, annual needs based assessment, etc., develop appropriate internal systems including policies and procedures to assure that the business is operating in a manner consistent with applicable laws, regulations and DePuy policy, develop appropriate transactional documents and procedures to assure day-to-day decisions are well supported, and clearly and properly documented, work in conjunction with franchise training resources to develop and implement appropriate education and training programs for field sales and internal personnel (commercial operations, medical affairs, R&D, others) concerning health care compliance. Responsibilities will also include programs covering new employee orientation as well as periodic training on specialized subjects and annualized refresher training. Leveraging existing training resources across the Franchise and Corporation. Develops and provides regular communications on HCC directed to field sales and other covered employee organizations. Implementing recommendations from both DePuy self-assessments/monitoring and internal/external audits. Conducting appropriate investigations including investigations initiated for-cause, those based on anonymous reports of potential misconduct or otherwise as directed by legal counsel. Investigations including reviewing and evaluating documents and records, personnel and customer interviews, report drafting. Results of investigations are reviewed with appropriate management and the law department. A minimum of a Bachelors Degree is required. A Juris Doctorate is preferred. A minimum of 10 years business experience is required. Experience in Health Care Compliance, including HCC Programs and Strategy Development, is required. Experience in one or more of the following is required: Legal, Finance, Regulatory, Sales and/or Marketing. Experience directly managing a team is required. Experience with HCC Guidance Documents, laws and regulations, anti-kick back FDA, OIG (Office of the Inspector General) and AdvaMed Code is preferred. Exceptional written and verbal communication skills are required. Broad commercial experience, with an understanding of the aspects of marketing, sales, and related business functions is required. Experience with the development of appropriate compliance systems for finance and/or quality assurance is preferred.
