Manager - eDISCOVERY and Forensics

Electronic Discovery (eDiscovery) is preservation, retrieval, exchange, and production of documents from electronic sources in electronic form. eDiscovery is typically initiated via outside legal requests to the internal Legal department in response to litigation.
eDiscovery Investigations will be conducted on a global basis for the purpose of locating and recovering data (civil or criminal), identifying custodians (employees) and assessing/providing appropriate collection and preservation tactics.
Candidate will be primary support for Electronic Discovery (eDiscovery) litigation requests from SPE Legal. He/She will also provide Forensics Lab management support as well as investigations backup. Candidate will provide overall management and organizational support for organizing and further developing an already established model for the receiving of eDiscovery requests within Legal, the communication of these requests to the incumbent or designated representative, and the processing of requests with close and continual coordination with the assigned Legal representative for each project, The processing of requests will involve identification of each custodian (employee) for each project, the identification of all potential electronic data repositories for each custodian, the gathering of all requested specific data, and the organization of, searching, culling, and production of data back to Legal to fulfill the subpoena request. Projects can range from 5 to 50+ custodians (employees) per request.
Essential Functions:
• Serve as primary contact for the client and provide professional, timely communication between client and the eDiscovery Manager and team.
• Track and monitor all project activity and update project plans as required.
• Provide all project documentation, archive all appropriate records and monitor compliance requirements to ensure consistent, high quality work.
• Efficiently analyze project problems and provide viable solutions for clients.
• Plan, Collect, Filter, Cull, and Validate identified data.
• Install, configure and trouble-shoot computer hardware, forensic and eDiscovery software and LAN issues.
• Use EnCase Enterprise software to extract native digital files and e-mail archive files from hard drives and evidence files.
• Perform technical data management activities, such as merging data into database applications, merging images into image viewing applications and converting data into various platforms.
• Coordinate eDiscovery and document production processes with attorneys and paralegals.
• Ensure quality control of the eDiscovery chain of custody, staging, processing and production process.
• Provide technical support to eDiscovery attorneys.
Candidate must have good oral and written skillsets (reports) and must be able to effectively interface and work with internal and external legal staff, Senior company executives, and line employees.
Computer technical skills and experience are required, particularly in computer forensics. Forensic certification is required (EnCE preferred), but company will assist candidate with getting certification if adequate computer technical experience is present. Certification must be sustained as well as stay current with emerging technologies and best practices.
Establishing of close liaison with legal, HR and risk management is imperative. Some eDiscovery investigations will require utilization and management of external resources. Candidate needs a thorough understanding of eDiscovery processes/procedures, best practices, rules of evidence, civil procedure (in particular - The Federal Rules of Civil Procedure as it relates to eDiscovery) and must keep updated regularly.
The job requires the incumbent to understand and support the need for extreme confidentiality. He/She will have all levels of access and will be exposed to and handle data that is highly sensitive. The sensitivity of the position allows for little or no error in its execution. These requirements dictate that the candidate be someone of not only strong technical skills, but with excellent organizational and critical thinking skill sets that allows them to operate independent of management as needed.
In some instances other members of the security or safety staff may conduct eDiscovery investigations. The incumbent will be responsible for providing guidance and direction.
Establishment of an eDiscovery Project tracking process to ensure chain of custody and integrity.
70% - eDiscovery/Investigate (conduct interviews, identify data sources, provide counsel and guidance, gather data, prepare reports, coordinate with other departments, coordinate computer forensics efforts, review all eDiscovery requests to ensure matters are addressed appropriately and expeditiously)
10% - lnternal/External liaison (build relationships with counterparts, participate in associations such as HTCIA) both domestically and internationally
10% - establish an efficient eDiscovery tracking database, conduct trend analysis, provide briefings to staff and management, create eDiscovery policy and standards.
05% - learn SPE's business to explore ways of improving efficiencies from: eDiscovery requests; improve lab processes/procedures; stay updated on legal requirements/changes in regards to eDiscovery requirements and compliance.
05% - provide eDiscovery awareness programs for staff to include teaching/updating on eDiscovery and lab protocols.
Certification/Licenses: EnCE or equivalent
X Other (Please specify) Certified Fraud Examiner preferred, Computer Forensics skills/experience a strong plus
Experience: This position requires experience in conducting and/or leading eDiscovery projects of a complex and sensitive nature. A combination of computer technical and project management experience is ideal. International experience is also preferred. Previous experience in providing witness testimony both at trial and in depositions is preferred.

Knowledge A thorough understanding of eDiscovery processes/procedures, rules of evidence, civil procedure (in particular - The Federal Rules of Civil Procedure as it relates to eDiscovery), interviewing techniques, report writing and computer usage is required.
Skills In-depth computer technical skills, strong verbal/written communication skills. Strong conceptual, analytical and visionary skills.
Ability Willingness and desire to work in both a tactical and a strategic way. Must possess the confidence and ability to interact at all levels of the organization both in written and oral presentation. Position requires on-call availability. Travel is necessary. Physical requirements include being able to access all company facilities worldwide.
