Every location offers an environment that values each of its employees!Job Description:The Benefits Attorney is responsible for the employee benefit law functions for the Company. This includes compliance with all employee benefit laws. Advises employee benefits department on benefit-related litigation. In addition, the position must provide timely advice to management on employment related topics. Job duties include:Create and update benefit plan documents to reflect legislative and regulatory changes, plan design changes and transition provisions related to acquisition and divestitures, etc. Review and revise third party vendor contracts for compliance with Company policies and standards. Assist Benefits Department in review of policies, processes and operations to ensure they are compliant with legal requirements and plan documents. Manage and coordinate certain filings with government agencies and interface with these agencies as necessary. As part of due diligence activities, review acquisition target’s plan documents, vendor contracts and all government filings. Review benefit communication materials. In conjunction with the Benefits Department, monitor operation of subsidiary’s benefit plans to maintain compliance with legal requirements and Company policy. Coordinate preparation of benefit–related proposals for submission to the Board of Directors and internal committees. Update and perform employee training as required (e.g. HIPAA training). Coordinate activities of outside benefits counsel. Assist Benefits Department in interpretation of plan provisions. Assist in resolution of benefits-related tax reporting and compliance issues. Represent Company before and handle matters filed with federal and state administrative agencies, including National Labor Relations Board, Equal Employment Opportunity Commission, Office of Federal Contract Compliance Programs and their state counterparts. Provide advice to Human Resources and other Company personnel on various issues relating to employment and labor, including contract administration and interpretation, civil rights and discrimination, discipline and personnel policy issues. Prepare, coordinate and consult with Human Resources personnel regarding separation agreements and oversee the administration of Company severance programs in conjunction with Human Resources. Conduct training sessions in conjunction with Human Resources personnel on the legal and practical aspects of labor and employment law issues for St. Louis and field personnel. Develop and/or review Company policies and procedures impacting the labor, employment, employee benefits and safety areas.Job Qualifications: JD Degree required. 2-6 years experience in the employee benefit area. Knowledge of ERISA and the related tax laws is mandatory. Must be knowledgeable in benefit plan development and operation. Experience with multi-employer plans and/or corporate acquisitions are considered a positive. Labor and employment experience is preferable but not required.
