Tribal Prosecutor

The Prosecutor supervises the prosecution of cases filed on issues regarding tribal sovereignty and the exercise of tribal jurisdiction over child welfare, juvenile delinquency matters, criminal law violations, and traffic violations. The Prosecutor will represent the Tribe in all hearings before the Tribal, State and Federal Courts.  Presents information in an ethical manner, assuring that justice is upheld according to the laws of the Prairie Band Potawatomi Nation. 

 

Duties/Responsibilities:

1.  Plans, organizes, directs, implements, and seeks alternative approaches to prosecution activities as well as administrative functions.

2.  Reviews legislation affecting criminal prosecution.

3.  Conducts pre-trial investigations necessary to case preparation, including but not limited to consulting with tribal law enforcement officers, other law enforcement agencies and witnesses.

4.  Prepares standards and procedures for and coordinates work of professional and administrative support staff.

5.  Conducts research for and gather evidence in assigned cases.

6.  Prepares and responds to post-trial motions and represents the Tribe at sentencing hearings.

7.  Gives oral and written advice to the Tribal Council, Executive Director, and other officials or department heads on matters pertaining to criminal law which actually does or may involve the PBP Nation.

8.  Preparation, trial work, legislative analysis, and other special projects on the basis of their varying backgrounds and capabilities.

9.  Works with juvenile agencies and social service agencies or other programs for the prevention and solution of juvenile delinquency, and child abuse or neglect.

10.  Represents the Tribe’s interest in Tribal or State court in Indian Child Welfare Cases.

11.  Represents the PBP Nation in Tribal, State, and Federal Courts in cases pursuant to the federal Indian Child Welfare Act.

12.  Assists the Director of Social Services in the continual training of the Social Services staff

13.  Assists the Director of Social Services with the negotiation and procurement of State contracts deemed necessary.

14.  Advises the Director of Social Services on legal courses of action in child welfare cases occurring in State Court.

15.  Participates in regular staffing with the Indian Child Welfare Program Staff.

16.  Researches and assists the Tribal council regarding the above designated areas of responsibilities.

17.  Performs other duties as assigned.

 

Minimum Qualifications:

Minimum: Law Degree.

Preferred:  Law Degree.

Field of Study:  Law.
