JOB SUMMARY: In this role you will be a member of the Legal Department, reporting to the Vice-President and Senior Litigation Counsel, and will have ultimate responsibility for ensuring compliance with the Legal Hold Protocol. The Legal Hold Administrator will coordinate and continuously seek to improve all e-mail, electronic documents and data retention, collection and production procedures to ensure compliance with legal obligations and the established Legal Hold Protocol.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
Assisting in the development and implementation of electronic document and data retention, collection, and production procedures for litigation matters involving Hill-Rom and its subsidiaries and affiliates.Monitoring and updating electronic document discovery procedures to ensure compliance with legal obligations.Drafting, updating, issuing, and monitoring Litigation Hold Notices for the various claim/litigation classifications, including products liability, commercial, intellectual property, automobile accidents, bankruptcy, premises liability, and general tort litigation.Serving as a liaison with all levels of personnel across Hill-Rom for the document/data collection and retention process.Analyzing and distinguishing claims that are to be considered as anticipated litigation claims and subject to federal rules regarding document retention.Working with IT personnel, vendors, and outside counsel in implementing document holds, collecting electronic documents and data, conducting privilege and relevance reviews, and producing electronic documents and data.Documenting steps taken to preserve, collect and produce electronic documents and data.Serving as designated e-discovery witness to testify (both in writing and orally) regarding compliance with e-discovery requirements.Educating management on proper document retention and destruction policies, compliance with litigation hold notices, and e-discovery procedures.Developing and maintaining an understanding of current computer application and systems, the owners of those applications and systems, and the data and documents such applications and systems generate and retain.Managing a designated portion of Hill-Rom’s claims and litigation caseload.Conducting legal research as necessary.Assisting Hill-Rom lawyers and outside counsel in preparing for corporate meetings, hearings, and trials.Serving as liaison for outside counsel in prosecuting or defending claims on behalf of Hill-Rom and its subsidiaries and affiliates.Gathering and reviewing documents and information for responding to discovery, preparing disclosures, and for prosecuting or defending claims.Updating Hill-Rom’s automated case/claims tracking systems.Investigating the facts of claims and cases to ensure that all relevant information and strategy is considered.Analyzing and organizing case/claims files.Preparing written reports as assigned, including update summaries of cases and claims and status updates.Assisting as assigned in drafting pleadings and motions, drafting contracts and settlement agreements, obtaining affidavits, and gathering evidence.Assisting Vice President of Litigation as assigned in gathering data and drafting letters and reports.Coordinating and gathering documentation necessary to respond to subpoenas ensuring compliance with HIPAA.Other duties may be assigned.
EDUCATION AND/OR EXPERIENCE REQUIRED:
Minimum of Bachelor’s Degree or equivalent in Paralegal Studies. Five years litigation experience in a corporate environment, with a focus on the discovery process, including document production procedures, Electronically Stored Information (ESI), and Litigation Holds.Proficiency in the use of computer systems including Microsoft Word and Lotus Notes. Experience with Email Xtender preferred, but not necessary.Outstanding organization and communication skills. Highly motivated with strong work ethic. Possess exceptional attention to detail. Ability to work well independently. Ability to meet deadlines and work well under pressure.
