Senior Environmental Risk Analyst
General Summary
Evaluates, underwrites and manages all environmental issues and liabilities associated with acquisitions, dispositions, leases and owned properties of FR, its JV partners and lenders.
Performs and tracks all aspects of environmental due diligence and geotechnical investigations for property transactions (acquisitions and dispositions).
Conducts a detailed analysis and preparation of cost estimates to assess the feasibility of, and compliance with, the approved terms of a transaction. Quantifies and assists in requests for price reductions.
Essential Job FunctionsCoordinates, engages and manages due diligence efforts of environmental and geotechnical consultants. Reviews and analyzes results to confirm compliance with transaction terms and underwriting as well as requirements of JV partners and lenders. Proactively reviews all environmental information for properties in the disposition pipeline and prepares a summary for the transaction team. Anticipates questions, evaluates alternatives and recommends strategy to reduce or mitigate financial impact to approved terms of transaction. Reviews and evaluates existing leases to determine and define environmental responsibilities of tenants and potential liabilities to FR and its JV partners. Develops solutions to transfer risks associated with unacceptable liability/exposure.Reviews, evaluates and negotiates environmental, indemnity and restoration provisions in contracts and leases. Requires extensive interaction with buyers, sellers, lenders, attorneys and tenants.Prepares summaries/memorandums for, and assists in presentations of, MC/IC and JV books and conference calls.Develops strategies, cost estimates and budgets to obtain regulatory closure of environmental issues. Coordinates with regional personnel, attorneys, consultants and regulatory agencies. Oversees and manages environmental consultants to assure completion within time and budget allowances.Monitor and approve disbursement from environmental escrow accounts and accruals setup in conjunction with property acquisitions. Addresses other environmental and various compliance issues on portfolio assets for potential and current tenants.Assist in preparation of annual environment Budgets for regions and annual environmental liabilities disclosures in the Company’s financial statements. Assist Director of Environmental in obtaining environmental insurance for transactions or portfolio projects.Performs research and analysis of current and proposed state and Federal environmental regulations.Responds to numerous questions and requests for documentation from JV Partners and lenders. Coordinates and engages geotechnical investigations and evaluates contractual provisions and obligations of general contractor of same.Prepares Environmental Due Diligence recap for approval by Director of Environmental. Performs other duties, some of which, may be essential to the position.
Knowledge, Skills, and AbilitiesKnowledge of real estate, commercial leases, transactions and the insurance provisions of same keeping at a level normally acquired through completion of a Baccalaureate degree, and approximately 6-12 years related experience. Knowledge of environmental issues and regulations normally acquired through approximately 6-12 years of on the job experience or through completion of training in environmental due diligence and/or environmental investigation and remediation strategies.Understanding of a wide range of subjects including impacted soils and groundwater, wetlands, endangered species, cultural and historical impacts, flood plains, asbestos, lead (in paint and drinking water), state and Federal regulations, regulatory compliance and environmental insurance products.Strong interpersonal and telephone communication skills. Excellent written communication skills including ability to prepare accurate and appropriate documentation and summaries. Rigorous analytical and effective negotiation skills. Computer skills necessary to enter and manipulate words and data and use standard microcomputer-based software to communicate with others, prepare documentation, and/or analyze data. Internal Contacts: Routinely interact with all company departments to gather and exchange information. External Contacts: JV partners, lenders, attorneys, brokers, consultants and government agencies to exchange information and complete research and analyses.
